Why is this not a hate crime?

Owosso, MI (LifeNews.com) -- Local officials and state police are confirming that a pro-life advocate was shot and killed outside a high school in this Michigan town. The person, who is described as well-known but whose identity has not been released, was shot multiple times while protesting abortion outside Owosso High School. h/t Michelle Malkin

Has it been established that the anti-abortion activist was targeted because of his views on abortion? Not that I know of.

Police are saying that the killer apparently targeted the victim for his views.

There was a lot of folks there with the victim. But only the victim was shot... repeatedly. If it was a random shooting, the shooter would've shot all over the place, not just focussing on one.

It's apparent that the shooter singled out and targeted the victim.

A jury would very likely convict based on this evidence. And it could easily be considered a "hate crime", but I predict that it won't, because, hey, since when does the Left care about pro-life folks? The Left isn't even saying anything, not condemning the murder, whereas they went crazy over the murder of the abortionist Tiller.

I think it is written in the constitution that you have to be homosexual, black, or a foreigner to be a victim of a hate crime.
